DJ guilty of contempt of court after NHS compensation bid
27/04/18An NHS Trust has brought proceedings against Sandip Atwal for contempt of court in clinical negligence proceedings. He has been found guilty of 14 counts.
Mr Atwal originally claimed £837,109 including large sums for future loss of earnings and care but later (5 years) accepted an offer of £30,000. He claimed that he could not work as a result of the treatment he had received but surveillance proved otherwise.
Thankfully we do not see many cases such as this however it is so disappointing to see the NHS having to spend precious funds litigating in this manner and proving that such claims are fraudulent.
I echo the sentiment expressed by NHS Resolution that whilst such cases should not deter genuine Claimants, this case should most definitely be seen as a demonstration of its commitment to combating fraud.
NHS Resolution, on behalf of Calderdale and Huddersfield NHS Foundation Trust, said the case should be seen as a demonstration of its committment to combating fraud but should not deter genuine claimants.
