Experience

Ed is a Principal Associate in Capsticks’ Commercial Litigation team and specialises in handling procurement challenges on behalf of contracting authorities and challengers. He supports a range of private and public sector clients, including NHS bodies, local authorities, and social housing providers to manage and resolve commercial disputes and procurement challenges.

Expertise

Ed has particular expertise in public procurement and complex contract disputes. Ed was a senior government lawyer for many years prior to joining Capsticks and advised central government departments including the Ministry of Defence, Home Office, Department of Health and Social Care and the Crown Commercial Service on some of their largest and most complex contract and procurement disputes.

Ed can provide advice at all stages of a dispute and works with contracting authorities and challengers to understand their key aims and drivers to deliver commercial, accessible and pragmatic advice.

Notable Projects

  • Representing an ICB in a large procurement dispute for a region-wide service which settled shortly before trial.
  • Successfully overturning a decision to disqualify a tenderer from a procurement for a place on a major IT services framework.
  • Representing the Ministry of Defence in a multi-million pound procurement challenge concerning hard and soft facilities management services across the defence estate.
  • Advising the Department for Health and Social Care in relation to various disputes concerning procurement during the Covid-19 pandemic.
  • Advising the Department for Work and Pensions in a claim raising complex questions regarding the lawful operation of framework agreements and call-off contracts awarded without further competition.
  • Representing an NHS body in a multi-million pound procurement challenge for the provision of soft-FM services including a successful application to lift the automatic suspension on contract making.
