Emma Rowley

Experience 

Emma is a Principle Associate and qualified as a barrister in 2007, having completed her Bar Vocational Course at The University of Law, attaining the grade “Very Competent”. She subsequently cross qualified as a solicitor in 2014 and has specifically been representing employers in Employment Tribunal claims since 2010. She has successfully conducted numerous employment tribunal and appeal cases ranging from unfair dismissal to more complex whistleblowing and discrimination claims.

Expertise 

Emma advises emergency services and healthcare clients on a range of employment law matters including disciplinary and grievance procedures, discrimination, conduct, capability, immigration, family friendly rights, pay, pensions, leave, policies and contracts. Recent examples include:

• Settled a case at Judicial Mediation for a police service in a sensitive claim with a risk of damage to reputation and public confidence for the client. The schedule of loss totalled £1.5 million for career-long loss, pension loss, injury to feelings and aggravated damages, which was settled for £40,000.  
• Won a 10 day Tribunal case for an NHS Trust involving race discrimination, victimisation and whistleblowing with a chronology spanning 2003 to 2019 in which the Claimant, a consultant, was claiming over £800,000. 
• Advising an Ambulance Trust on a 15 day employment tribunal claim and concurrent grievance process. 

Emma recently successfully undertook a 5 month secondment in-house with an Ambulance Trust as Interim Head of ER, advising HR Managers on complex cases, general employment advice to key stakeholders and handling ET claims. 

Emma supervises Solicitors and Paralegals and provides internal and external training sessions.

• Kuteh v Dartford and Gravesham NHS Trust [2019] EWCA Civ 818 (religious discrimination claim)  
• Al-Obaidi v Frimley Health NHS Foundation Trust [2019] EWHC 2357 (QB) (application for a final injunction to prevent a disciplinary investigation taking place)
