Experience
Raj is a Legal Director with Capsticks’ Employment and Pensions team. He advises on all aspects of employment law but his focus is on non-contentious TUPE and pension matters.
He acts for NHS bodies, Local Government, Social Enterprises, Charities, and organisations in the housing, emergency services and regulatory sectors.
Expertise
Raj has a particular expertise in the transfer of services and merger activity, including related pensions issues, as well as major organisational change projects.
He will guide you through TUPE processes and pension issues quickly and smoothly, bringing the insights gained from working with all sides of a transaction to advise on the application of duties under TUPE and pensions guidance, and to help reach agreement on transfer agreements.
He also delivers practical training sessions and workshops and inputs to the bulletins and e-alerts we tailor on these highly technical subject areas.
Notable projects
- Merger and Acquisitions and Service Provision Changes – due diligence, drafting transfer agreement terms, and advising on TUPE and pension issues
- TUPE and pensions advice in relation to joint venture partnership arrangements and s75 agreements
- A TUPE transfer from the Local Government to a Charity, including the drafting and negotiation of an Admission Agreement and Indemnity for pension purposes.
- Pension and TUPE issues involving transfers of emergency services employees
- Shared services arrangements, including pathology services across several Trusts
- Assisting with the employment practicalities and pension issues in relation to GP practice mergers, as well as the related documentation
