Experience

Tim is a Partner specialising in commercial disputes, particularly those involving procurement-related issues. He has over fifteen years’ experience of dealing with procurement disputes, acting for both contracting authorities and bidders.

Expertise

Tim regularly deals with disputes under the Public Contracts Regulations 2015, the Health Care Services (Provider Selection Regime) Regulations 2023 and the Utilities Contracts Regulations 2016.

He has been involved in many high value and high profile cases, several of which have received media/press interest. They include, successfully defending NHS England at trial in which a bid was not considered following issues around submission; successfully defending three Yorkshire-based NHS trusts in the award of a c.£500m pathology managed services contract; and successfully defending a central NHS body in a c.£5m dispute involving allegations of conspiracy and misfeasance in public office relating to the running of a procurement for specialist ambulance equipment.

Tim regularly provides training to clients on procurement litigation case law and strategy and is increasingly supporting clients regarding the implementation of the Procurement Act 2023.

Tim also regularly advises clients, both in the public and private sector, in respect of a range of commercial and contractual disputes. His recent work includes: representing a NHS trust in a high value dispute relating to the provision of defective scanning equipment (the case settling on favourable terms at mediation); acting in a multi-million pound dispute relating to alleged fire defects at a hospital; acting as part of a multi-disciplinary team representing a NHS trust in a multi-million pound dispute following the termination of a PFI contract due to alleged breaches by the provider; advising a large education provider in a dispute regarding commission payments due to an energy broker; and representing a commercial client in a multi-million pound breach of confidence claim (that case settling on favourable terms one week into a three week trial in the Commercial Court in London).
